Booking Terms & Conditions
These Terms and Conditions govern all bookings made with Savannah Journeys Ltd, a destination management company operating in Eastern Africa (Kenya, Tanzania & Zanzibar) and other parts of the continent. By engaging with us, the “Organiser” agrees to the terms outlined below. These terms are legally binding and form the full agreement between Savannah Journeys Ltd (hereafter “the Company”) and the Organiser.
Note: There is no direct contract between the Company and the Client (traveller); all agreements are made between the Company and the Organiser.
- Definitions
– The Company refers to Savannah Journeys Ltd, a limited liability company registered and operating in Africa.
– The Organiser means the individual or organization contracting Savannah Journeys to deliver services to Clients.
– The Client refers to the end traveller receiving services arranged by the Organiser through the Company.
– The Retailer refers to travel agents, agencies, or other intermediaries engaged by the Organiser. - Scope of Contract
– The Organiser acts as the principal party in all contracts with Clients. The Company operates only as a service provider on behalf of the Organiser.
– The Company accepts no contractual liability to the Client.
– Any agreements modifying these terms must be in writing and signed by an authorized representative of the Company. - Responsibilities of the Organiser
– All client-facing agreements must clearly state that the Company is acting solely as the Organiser’s agent.
– The Organiser shall fully indemnify the Company against all claims, disputes, or liabilities arising from or related to the Organiser’s agreements with Clients or Retailers. - Tour Services
While the Company will make every effort to provide services as agreed (including accommodation, transport, meals, and activities), it shall only be held liable in cases where services were not delivered due to the Company’s negligence.
– Liability is limited to reimbursing the actual cost of the undelivered service.
– No compensation will be made for consequential losses (e.g., missed flights, indirect costs, or emotional distress).
The Company reserves the right to substitute similar services of equal value where necessary, and will not be liable in cases involving:
i. Closures of parks, lodges, or other facilities due to circumstances beyond our control
ii. Acts or omissions by third-party suppliers not under the Company’s direct employment
iii. Delays or schedule changes affecting transport or connections
iv. Errors or schedule changes by airlines or travel agents (air travel is handled strictly as an intermediary)
Clients are strongly advised to secure comprehensive travel insurance to protect their interests.
- Subcontracting
The Company may, at its discretion, engage subcontractors to deliver some or all of the services. All protections and indemnities described herein shall also apply to such subcontractors. - Price Adjustments
Prices may be revised without prior notice to the Organiser under the following circumstances:
– Currency fluctuations against major world currencies (USD, EUR, GBP)
– Government-imposed taxes or levies
– Increases in fuel, transport, accommodation, or park entrance fees
– Any uncontrollable operating cost increase - Booking and Confirmation
– All bookings must be made in writing via email, website, or an authorized travel agent.
– A deposit of 30% of the total tour cost is required to confirm your booking.
– Final payment is due no later than 60 days before the departure date.
– If the booking is made less than 60 days prior to departure, full payment is required at the time of booking.
- Payment Terms
– Payments can be made via bank transfer, credit card (fees may apply), or other methods as agreed.
– All bank charges are the responsibility of the Client.
– Prices are quoted in USD and are subject to exchange rate fluctuations.
- Cancellation Policy
Cancellations must be received in writing and are subject to the following charges:
More than 60 days | Deposit only
31–59 days | 50% of total cost
15–30 days | 75% of total cost
14 days or less | 100% of total cost
No refunds will be given for unused services or early departures.
- Changes by the Client
– Changes to a confirmed booking may be possible, but are subject to availability and a change fee.
– Name changes are treated as cancellations and re-bookings.
- Changes or Cancellations by the Company
– We reserve the right to cancel or modify a tour due to unforeseen circumstances such as extreme weather, political instability, or minimum group size not being met.
– In such cases, we will offer an alternative tour, reschedule, or full refund.
- Travel Insurance
– Comprehensive travel insurance (including medical, cancellation, and evacuation coverage) is mandatory.
– Proof of insurance must be provided before departure.
- Health and Safety
– It is the Client’s responsibility to ensure they are medically fit to participate.
– Certain destinations may require vaccinations or malaria prophylaxis.
– The Company reserves the right to decline participation to anyone who may compromise the safety or comfort of others.
- Visas and Travel Documents
– Clients are responsible for ensuring they have valid passports, visas, and any required travel documents.
– The Company will provide necessary guidance but is not liable for denied entry or deportation.
- Liability
– The Company acts as an agent for hotels, airlines, and other service providers and is not liable for any loss, injury, delay, or damage resulting from their acts or omissions.
– The Company is not liable for force majeure events such as natural disasters, pandemics, strikes, or war.
- Client Responsibility
– Clients must comply with local laws and respect customs, wildlife, and the environment.
– Any client causing disruption or harm may be removed from the tour at their own expense without refund.
- Complaints and Claims
– Any issues must be reported immediately to the tour leader or our local office.
– Claims must be submitted in writing within 14 days of tour completion.
- Governing Law and Jurisdiction
– These Terms shall be governed by the laws of Kenya.
– Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
- Privacy
– Client data will be handled in accordance with our Privacy Policy and used only for travel purposes and communication.
- Marketing and Media
– Unless otherwise stated in writing, the Company may use photos or videos taken during the tour for promotional purposes.
